What is Scope ruling?
A Commerce Department decision on whether a particular product falls within the scope of an antidumping or countervailing duty order.
AD/CVD orders define their coverage in words, not by HTS code; the HTS numbers listed in an order are for convenience only. When it is unclear whether a product is covered, an importer, a foreign producer or a US industry member can ask the Commerce Department for a scope ruling, and Commerce can also start one itself.
Commerce looks at the written scope, the record of the original investigation and earlier rulings, and sometimes the product's physical characteristics, uses and channels of trade. Rulings are published and are often cited for similar products.
Before ordering a product near the edge of an order, for example hotel casegoods that might count as wooden bedroom furniture, check existing scope rulings with a customs broker or trade lawyer. It costs far less than paying deposits you did not plan for.
