What is UFLPA (Uyghur Forced Labor Prevention Act)?

A US law presuming goods made wholly or partly in Xinjiang, or by listed entities, involve forced labor and are barred from import unless proven otherwise.

Since June 21, 2022, the UFLPA has created a rebuttable presumption that goods mined, produced or manufactured wholly or in part in China's Xinjiang region, or by entities on the UFLPA Entity List, are made with forced labor and cannot be imported. CBP can detain, exclude or seize such goods.

To get goods released, the importer must show due diligence and provide clear and convincing evidence that they were not made with forced labor, which in practice means tracing the supply chain down to raw materials. DHS names high-priority sectors for enforcement, which have included cotton, polysilicon, PVC and aluminum.

The risk is not only where the factory is: a factory in Guangdong can use Xinjiang cotton or aluminum. Ask suppliers for material origin documents at the quoting stage, and choose other materials where traceability is weak.
