What is Section 301 tariffs?

Additional US duties on Chinese-origin goods imposed by the US Trade Representative under the Trade Act of 1974, set by HTS code on top of normal duty.

Section 301 of the Trade Act of 1974 lets the US Trade Representative (USTR) act against foreign trade practices it finds unfair. Since 2018, USTR has imposed additional duties on a large share of imports from China, organized in lists by HTS code, with rates that differ by list. They apply to goods whose country of origin is China, wherever they ship from.

Coverage and rates have changed many times through reviews, increases and product exclusions, some of which expire. Whether a product is covered depends on its exact HTS code, so check the current USTR lists or ask a customs broker when you get a quote.

Moving final assembly to another country only changes the origin if the product is substantially transformed there. Repacking or minor assembly does not, and a false origin claim can lead to penalties.
